Terms of Service

Including the End User License Agreement for Pro subscribers.

TL;DR

Use the site. Don't be a jerk. Don't steal our content. If you're a Pro subscriber, you get more features and a few more rules. We can terminate accounts that violate these terms. Standard stuff, written like a human.

1. Acceptance of Terms

By using ummm, no (the "Service"), you agree to these Terms of Service. If you don't agree, don't use the site. It's that simple.

These terms apply to all users: visitors, registered free users, and Pro subscribers. Pro subscribers are also subject to the additional EULA in Section 6.

If you're using the Service on behalf of an organization, you represent that you have authority to bind that organization to these terms.

2. The Service

ummm, no is a film and television verdict platform. We provide:

  • -Film and TV reviews and verdicts from Travis Bjorklund
  • -A searchable vault of reviewed titles
  • -A community discussion forum (The Discourse)
  • -Personalized recommendations via Taste Match
  • -Watchlist management and rating tools
  • -Pro features including advanced filters, early access, and ad-free browsing

We reserve the right to modify, suspend, or discontinue any part of the Service at any time. We'll give reasonable notice for significant changes.

3. Accounts

Registration

You can browse most of the site without an account. To save watchlists, post in The Discourse, or use Taste Match, you need to register.

Your Responsibilities

  • -You must be at least 13 years old to create an account
  • -You're responsible for keeping your password secure
  • -You're responsible for all activity under your account
  • -You must provide accurate information when registering
  • -One account per person - no sharing, no bots

Account Deletion

You can delete your account at any time from your dashboard settings. See our Privacy Policy for what happens to your data when you do.

4. Acceptable Use

The site exists to talk about film. Use it for that. Here's what you can't do:

  • -Post spam, advertising, or promotional content without permission
  • -Harass, threaten, or abuse other users
  • -Post content that's illegal, defamatory, or violates someone's privacy
  • -Attempt to hack, scrape, or reverse-engineer the site
  • -Create fake accounts or impersonate others
  • -Use automated tools to interact with the site without prior written permission
  • -Post content that infringes on copyrights or trademarks
  • -Attempt to manipulate verdict scores or ratings

We'll remove content that violates these rules and may suspend or terminate accounts that repeatedly violate them. We're not going to be draconian about it - but we're also not going to let the site become a garbage fire.

5. Content

Our Content

All verdicts, reviews, editorial content, and site design are owned by ummm, no and Travis Bjorklund. You can quote brief excerpts with attribution. You can't republish full reviews, copy the site design, or use our content for commercial purposes without written permission.

Your Content

When you post in The Discourse or submit ratings, you grant us a non-exclusive, royalty-free license to display that content on the site. You retain ownership. We don't claim rights to your words beyond what's needed to run the platform.

You're responsible for what you post. Don't post anything you don't have the right to post. Don't post anything that would embarrass you in front of your grandmother.

TMDB Attribution

Film metadata, posters, and cast information are provided by The Movie Database (TMDB). This product uses the TMDB API but is not endorsed or certified by TMDB.

6. Pro Subscription - End User License Agreement (EULA)

What Pro Gets You

A Pro subscription grants you a personal, non-transferable license to access premium features including:

  • -Ad-free browsing across all pages
  • -Early access to new verdicts before public release
  • -Advanced vault filters and sorting options
  • -Full Taste Match algorithm with detailed breakdowns
  • -Unlimited watchlist entries (free tier is limited to 50)
  • -Exclusive Pro-only Discourse threads
  • -Monthly "Critic's Picks" curated list delivered to your inbox
  • -Priority support response (48 hours vs. 5 business days)

License Restrictions

Your Pro license is for your personal use only. You may not:

  • -Share your Pro account credentials with others
  • -Resell, sublicense, or transfer your Pro subscription
  • -Use Pro features to build competing products or services
  • -Scrape or systematically download Pro-gated content
  • -Circumvent any Pro feature restrictions for non-Pro users

Subscription Terms

  • -Pro subscriptions are billed monthly or annually, as selected at signup
  • -Subscriptions auto-renew unless cancelled before the renewal date
  • -You can cancel at any time - your Pro access continues until the end of the paid period
  • -No refunds for partial months, except where required by law
  • -Annual subscriptions may be eligible for a pro-rated refund within 14 days of purchase
  • -We reserve the right to change Pro pricing with 30 days notice

Pro Feature Changes

We may add, modify, or remove Pro features over time. We'll notify Pro subscribers of significant feature removals at least 30 days in advance. If we remove a core Pro feature without replacement, Pro subscribers may request a pro-rated refund for the affected period.

Termination of Pro Access

Your Pro access terminates if you cancel your subscription, your payment fails and isn't resolved within 7 days, or your account is terminated for violating these terms. Upon termination, you revert to free tier access. Your data (watchlist, ratings, etc.) is retained unless you delete your account.

7. Payments and Billing

Payments are processed by Stripe. By subscribing to Pro, you authorize us to charge your payment method on a recurring basis.

  • -All prices are in USD unless otherwise stated
  • -Taxes may apply depending on your location
  • -Failed payments will result in a 7-day grace period before Pro access is suspended
  • -You can update your payment method at any time in your account settings
  • -Refund requests are handled case-by-case - contact [email protected]

8. Intellectual Property

The ummm, no name, logo, verdict system, site design, and all original editorial content are the intellectual property of Travis Bjorklund and ummm, no. All rights reserved.

You may not use our name, logo, or branding without written permission. You may not republish our verdicts or reviews in full. Brief quotations with clear attribution are permitted under fair use.

9. Disclaimers

The Service is provided "as is" without warranties of any kind. We don't guarantee the site will be available 100% of the time, that verdicts will align with your taste, or that any specific feature will remain available indefinitely.

Film verdicts are opinions. They are the opinions of Travis Bjorklund. They are not objective facts. Reasonable people can disagree about film. (They're wrong, but they can disagree.)

10. Limitation of Liability

To the maximum extent permitted by law, ummm, no and Travis Bjorklund will not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service.

Our total liability to you for any claim arising from these terms or the Service will not exceed the amount you paid us in the 12 months preceding the claim. If you're a free user, that's $0.

Some jurisdictions don't allow limitation of liability for certain types of damages. In those jurisdictions, our liability is limited to the maximum extent permitted by law.

11. Termination

You can stop using the Service at any time. You can delete your account from your dashboard settings.

We can suspend or terminate your account if you violate these terms, engage in abusive behavior, or for any other reason with reasonable notice. For serious violations (illegal activity, harassment), we may terminate immediately without notice.

Upon termination, your license to use the Service ends. Sections that should survive termination (intellectual property, disclaimers, limitation of liability) will survive.

12. Governing Law

These terms are governed by the laws of the State of Texas, United States, without regard to conflict of law principles. Any disputes will be resolved in the courts of Bexar County, Texas.

If you're outside the United States, local laws may provide you with additional rights. Nothing in these terms is intended to waive rights you have under applicable local law.

13. Changes to Terms

We may update these terms from time to time. For material changes, we'll notify you via email (if you have an account) and post a notice on the site at least 30 days before changes take effect.

Continuing to use the Service after changes take effect means you accept the updated terms. If you don't agree with the changes, you can delete your account before they take effect.
